These Terms of Service (“Terms”) govern your access to and use of the Gjonaj Management website, resident portal, and any related online services, content, and tools (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
1. Who we are
“Gjonaj Management,” “we,” “us,” and “our” refer to Gjonaj Management and its affiliates, owners, employees, and agents.
The Services are provided for general information, leasing inquiries, and resident support functions such as portal access, rent payment links, maintenance requests, communications, and related property-management operations.
2. Eligibility and account access
Eligibility. You must be at least 18 years old to use the Services. If you are under 18, a parent or legal guardian must use the Services on your behalf.
Resident portal accounts. Some features require an account (the “Resident Portal”). You agree to provide accurate information and keep your account details current.
Activation and invitations. Resident Portal access may be provided by invitation/activation email. If you are not an authorized resident or user, you may not access the Resident Portal.
Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately if you believe your account has been compromised or used without authorization.
3. Acceptable use
You agree not to:
1. Use the Services for unlawful, harmful, or fraudulent purposes
2. Attempt to gain unauthorized access to accounts, systems, or data
3. Interfere with or disrupt the Services or security features
4. Upload or transmit malware, spam, or abusive content
5. Submit false or misleading information (including maintenance requests)
6. Use the Services to harass, threaten, or violate the rights of others
7. Copy, scrape, reverse engineer, or exploit the Services except as permitted by law
We may suspend or terminate access if we reasonably believe you violated these Terms or misused the Services.
4. Portal features and resident communications
Maintenance requests. The Resident Portal may allow you to submit maintenance requests and related information (including photos). You agree to provide accurate details and respond to follow-up questions needed to schedule service.
Service timelines. We aim to respond and coordinate service promptly; however, response and completion times may vary based on urgency, access, parts availability, vendor schedules, building conditions, weather, and other factors.
Emergency issues. The portal is not guaranteed to be monitored 24/7. For emergencies involving immediate danger, fire, gas odor, serious flooding, or urgent safety risks, contact emergency services (911) and follow any emergency instructions provided in your lease or building notices.
Notices and messages. We may send you communications related to your account, building notices, maintenance updates, leasing processes, and other operational matters. You consent to receive these communications electronically (email, portal notifications, text where applicable) as permitted by law.
5. Rent payments and third-party payment processors
Third-party payments. Rent and fee payments may be processed by third-party payment providers. When you use those services, their terms and privacy policies apply.
No banking storage. We generally do not store full payment card numbers on our systems. Payment details are typically handled directly by the payment processor.
Payment issues. You are responsible for ensuring payments are submitted correctly and on time. If you believe there is an error, contact us promptly and keep any confirmation or receipt.
No legal advice. Payment information and portal records are provided for convenience and do not replace your lease, ledger, or official notices.
6. Leasing and application information
The Services may include listings, availability information, and tools to request tours or apply for housing. All leasing is subject to:
1. Availability and verification
2. Screening (where applicable and permitted by law)
3. Lease terms and building policies
4. Applicable federal, state, and local laws (including fair housing laws)
Submitting a tour request or application does not guarantee approval or availability.
7. User content
You may submit content through the Services such as messages, requests, photos, and documents (“User Content”). You retain ownership of your User Content, but you grant us a non-exclusive, royalty-free license to use, store, reproduce, and display it as needed to operate the Services, respond to requests, maintain records, and comply with legal obligations.
You represent that you have the rights to submit the User Content and that it does not violate law or the rights of others.
8. Intellectual property
The Services and all content (text, branding, logos, design, software, and materials) are owned by Gjonaj Management or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works except with our written permission or as allowed by law.
9. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Services, you agree to the practices described there.
10. Disclaimers
The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law:
1. We do not guarantee uninterrupted, error-free, or secure operation of the Services
2. Listings, images, and availability may contain inaccuracies or may change without notice
3. We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement
11. Limitation of liability
To the maximum extent permitted by law, Gjonaj Management and its affiliates, employees, agents, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising from or related to:
1. Your use of (or inability to use) the Services
2. Unauthorized access to or alteration of your transmissions or data
3. Any conduct or content of third parties
4. Errors, delays, interruptions, or security vulnerabilities beyond reasonable control
If liability is found, our total liability for any claim related to the Services will not exceed the amount you paid us (if any) for use of the Services in the 12 months prior to the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless Gjonaj Management and its affiliates, employees, agents, and service providers from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
1. Your use of the Services
2. Your User Content
3. Your violation of these Terms
4. Your violation of any law or third-party rights
13. Termination
We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms, misused the Services, or used the Services unlawfully. You may stop using the Services at any time.
Certain sections will survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.
14. Changes to the Services or Terms
We may update the Services or these Terms from time to time. If we make material changes, we will update the “Effective Date” and may provide notice through the Services or by email. Your continued use after changes become effective means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
Dispute resolution. Before filing a formal claim, you agree to contact us to try to resolve the issue informally. If a dispute cannot be resolved, any legal action must be brought in the state or federal courts located in New York, New York, unless applicable law requires otherwise. You consent to the personal jurisdiction of those courts.
